Last Will
and Testament
W.G. Brown
State of
Georgia County of Dooly
I, W.G.
Brown of the County of Wilcox State of Georgia being of sound and
disposing mind and memory do make this my last will and testament.
Item One
I give and
bequeath to my wife Mrs. W.G. Brown City lots nos. 1-2-3-4-5-6-7-8-9 and
10 in block No. 12 in the Town of Rochelle Wilcox County Georgia to have
and to hold said property for and during her natural life with
limitations over to my four children Walter E. William G. Mildred T. and
Annie Wilmer Brown said property herein devised to be equally divided
among my said children after the death of my said wife.
Item Two
I give and
bequeath to my son Walter E. Brown City lot No. 2 in block No 13 the
West half of City lot No. 3 in block No 13 and lot No. 2 in block No. 14
in the town of Rochelle Wilcox County Georgia.
Item Three
I give and
bequeath to my son William G. Brown all of lot of land No 99 Containing
490 acres more or less and 8 acres of lot of land No 98 both of said
lots lying and being in the First District of Wilcox County Ga and known
as the Green place. The 8 acre tract referred to in this item is all the
land I won and possess in said lot No. 98.
Item Four
I give and
bequeath to my daughter Mildred T. Brown 100 acres of lot of land No 91
in the First District of Wilcox County Ga the same being all of the land
held and possessed by me in said lot and known as the Vinson place also
60 acres of lot of land no 211 and 90 acres of lot of land No 205 each
of said tracts lying and being in the Twelfth District of Wilcox County
GA and known as the Smith place said 160 and 90 acre tracts being all of
the land held and possessed by me in said respective lots.
Item Five
I give and
bequeath to my daughter Annie Wilmer Brown 88 acres of lot of land No
277 in the Eighth District of Wilcox County Ga known as the Weeks place
and being all of the land in said lot owned and possessed by me. Also
City lots nos. 18-19 and 20 in block No. 17 in the town of Rochelle
Wilcox County Ga and also 50 by 100 feet in the South West corner of
block no. 13 in the town of Rochelle Wilcox County Ga.
Item Six
It is my
will and desire and I hereby direct that the Brown Banking Co. of
Rochelle Wilcox County Ga be continued as at present with my son Walter
E. Brown as president and at a Salary of $100.00 per month and house
rent of $25.00 per Month the said banking business is to be continued so
long as it pays all operating expenses and earns an annual dividend of
8% any annual dividend above 8% is to be passed to the Surplus fund. It
is my will and desire and I hereby direct that said banking business be
wound up and the assets thereof be equally divided between my four
children herein before named on the first failure to pay operating
expenses and an annual dividend of 8%. My purpose and intention being
that said business shall be continued and conducted under the conditions
here before stated in the town where said business is now located so
long as the business pays an annual dividend of 8% over and above all
expense but that it shall be liquidated and its assets divided as herein
before provided in this item of my will as soon as it fails to earn and
pay an annual dividend of 8% above all operating expenses.
Item Seven
It is my
will and desire and I hereby direct that the Mercantile Business of W.G.
Brown & Co. including all of its stock notes accounts and assets of
whatever character and description be held together and continued under
the management and supervision of my friend T.C. Well at a Salary to him
of $100.00 per Month and Commission of 10% of the net profits earned by
said Mercantile business 90% of the Net profits of said business are to
be paid over to my wife Mrs. W.G. Brown annually to be used in the
support education and maintenance of my said wife and her children
herein before named. It is my Will that said business be conducted
within the town of Rochelle Wilcox County Ga and that said business be
conducted as it now exists or should said business be incorporated by me
or during my life time that it be continued as a Corporation after my
death. In the event said mercantile business fails to show a net profit
of 10% at the end of any year after my death it is my will and desire
that said mercantile business be liquidated and the entire proceeds
thereof said assets paid over to my wife Mrs. W.G. Brown it being my
intention that said business shall be liquidated and disposed of as
herein provided at the end of the first year in which it fails to show
an net profit of at least 10% upon its present investment or upon such
capitol as it may have should it be incorporated by me during my life It
is my intention further and I hereby will and direct that said
mercantile business pay to my son Walter E. Brown a monthly rental of
$75.00 for the use of its present location.
Item Eight
It is my
will and desire that all other property not herein mentioned and devised
including all my life insurance go to my wife Mrs. W.G. Brown for her
use and benefit during her life time and that all of the property
divided under this item of my will be equally divided between my four
children upon the death of my wife. It is my will and desire that all of
my debts if any I shall leave be paid by my executrix hereinafter named
out of the proceeds of my Life insurance policies, and the remainder of
all property herein devised by this item of my Will including the
remainder of my life insurance be divided equally among my four children
herein before named upon the death of my said wife.
Item Nine
I hereby
constitute and appoint my beloved wife Mrs. W. G. Brown as sole
Executrix of this my last will and testament and as guardian of my four
children herein before named or such of them as may not have reached
their majority at the time of my death and it is my wish and will that
she give bond both as executrix and as guardian of my several children
in an approved security company conditioned as required by law said bond
to be reasonable in amount.
Full and
express power to sell any of my property not specifically devised and
referred to in my last will is hereby given to my executrix and she
shall not be required to obtain any order to sell any or all of said
property real or personal and she may likewise sell the same at public
or private sale. It is my wish and will that my said wife manage and
control my said estate as executrix and the property of my said children
as guardian or such of them as may not have reached their majority at
the time of my death in the best interest of my estate and of my heirs
including my wife and that she use her best judgment in Administering my
estate in accordance with the terms an Conditions of this Will and I
recommend and wish her to Consult my friend W.F. George of Vienna Ga in
carrying out the terms and conditions of my will and in the making of
all sales and in changing the status of any of the property which she is
permitted to sell under my will so long as he remains a resident of the
State of Georgia and is conveniently accessible to my executrix . This
last wish is not a condition or limitation upon the rights of my
executrix to manage control and execute this my last will but is in the
nature of a wish and recommendation to my said wife. In testimony
whereof I have hereunto set my hand this the 10th day of
March 1014.

of the undersigned who subscribe our names hereto as Witnesses at the
instance and request of said testator and in his presence and in the
presence of each other we and each of us signing our names after the
said W.G. Brown had signed his This the 10th day of March
