Last Will and Testament of Smith Turner
Georgia Wilcox County
In the name of God, amen, I Smith Turner of the county
of Wilcox and the State of Georgia being of sound & disposing mind & memory &
being desire to settle my worldly affairs while I have strength to do so, do
make & publish this my last will & testament hereby revoking all wills by me at
any time hereupon made and (illegible).
First I commit my soul to God who gave it, & my body I
desire to be buried in the family graveyard on the southwest side of the Alapaha
on the land now owned and occupied by James Turner in Irwin County Georgia & my
worldly estate I dispose of as follows.
Item 1st Unto my beloved wife Mary Turner I give &
bequeath all my household & kitchen furniture together with all my farming
implements of every description, the best horse on my place left to her own
selection, ten head of hogs of her own selection out of my stock of hogs & one
fifth of my entire stock of cattle.
Item 2nd Unto my daughter, Mary
Fitzgerald, I give & bequeath the south half of lots of land numbers one hundred
& eighty one and one hundred & eighty two lying & being in the first district of
originally Irwin, now Wilcox County, also lots of land no. four hundred & fifty
eight in the sixth district of originally Irwin, now Berrien County and one
fifth of my entire stock of cattle.
Item 3rd Unto my daughter Isabella Johnson,
I give & bequeath lot of land no. two hundred in the first district of
originally Irwin county now Wilcox county and all that part of land lot no. two
hundred & one being east of the branch heading near the town of Abbeville and
land lots in originally Irwin now Wilcox county & all that part of lot of land
no. 213 lying east of said which heading near Abbeville and town lots in
Abbeville Wilcox Co. Nos.27 part of Lot 28 all of lots 29, 30, & 31 also lot of
land no. two hundred & nineteen in sixth district of originally Irwin now
Berrien County & one fifth of my entire stock of cattle.
Item 4th Unto my daughter Martha Statham I
give & bequeath the north half of lots of land nos. one hundred & eighty one &
one hundred & eighty two first district originally Irwin now Wilcox County. Lot
of land no. two hundred & eighty two originally the sixth district of Irwin now
Berrien County & one fifth of my entire stock of cattle.
Item 5th Unto my daughter Caroline Turner I
give & bequeath lots of land number two hundred & one lying inside of the branch
heading near the town of Abbeville and that part of lot of land no. two hundred
& thirteen just south of Bluff Creek & west of the branch heading toward
Abbeville, originally the first district of Irwin county now Wilcox County and
lot number 6 in the town of Abbeville, lots no. two hundred & eigthty, three
hundred & eighteen & two hundred & seventy three originally the sixth district
of Irwin now Berrien County, also two likely cows & calves in addition to one
fifth of my entire stock of cattle & the east of all of what part of land no.
two hundred & two lying east of Bluff Creek, originally Irwin now Wilcox County.
Item 6th Unto my daughter Mary Fitzgerald &
Martha Statham I give & bequeath lot of land no. two hundred & eighty one to be
equally divided between them, the sixth district of originally Irwin now Wilcox
County.
Item 7th All of my property now belonging to
me at this time & what I shall have at the time of & not otherwise disposed of
in this my last Will & Testament. I desire to be placed in the hands of my
executors for to be disposed of as they think best after all my just debts &
funeral expenses shall be paid then all the rest & residue arising therefrom, if
any there be, to be equally divided amongst the heirs of my body.
In witness whereof I the said Smith Turner to this my
last will consisting of the foregoing fours sheets of paper have set my hand &
seal with the especial request of Elias Turner, Robert Fitzgerald & William
Statham to all of my executors to this my last will that they see to its having
effects in accordance to the dictation thereof.
This the twenty third day of October one thousand eight
hundred & eighty eight

Signed, sealed, published & declared by the above named
Smith Turner as his last Will & Testament in presence of us who at this request
in presence of each other have subscribed our names as witnesses hereto.

In person came S. Bowen one of the subscribing
witnesses to the Will of Smith deceased & saith that he saw Smith Turner sign
said Will as his last Will & Testament & saith that he signed said Will as a
witness for the object therein named. Sworn to & subscribed before me this
November 17 1881.
