Last Will
and Testament

In the Name
of God Amen. I, Lovina Bruce of said State and County do make declare
and publish this my last will and testament.
Item It is
my will and desire and I do hereby make the following disposition with
reference to the One hundred and fifty (150) acres of land on lot Number
two hundred and thirteen (213) in the Fifth 5th District of
said County of Wilcox which I now own being all of said lot except forty
acres is heretofore conveyed by me to C.R. Bruce and twelve to which I
have executed to A.B. Bruce. A bond for titles that is to say it is my
will that my son E.D. Bruce shall have and enjoy the use benefit and
income for and during his natural life of all of said land of which I
shall die seized and possessed with the special privilege and authority
to sell as mutch as Seventy five acres of said land and apply the
proceeds of said sale to the improvement of the remainder seventy five
acres for the use and benefit of my said son E.D. Bruce during his life
as may be necessary in his Judgment.
Item It is
my will that if my said son E.D. Bruce shall survive me that said land
remaining unsold under the provision of the foregoing item (illegible
word) the Seventy five acres to be in provided as therein set fourth
shall be the property of my daughter in law Mrs. Elmira Bruce wife of my
son G.W. Bruce My Grand daughter Alma Bruce daughter of my son G.W.
Bruce my Grand daughter Mrs. Leila Blue wife of D.A. Blue and the
children of my son J. I. Bruce and I hereby devise and bequeath said
land to them in fee simple after the death of my said son E.D. Bruce in
the following proportions to wit – one fourth to Mrs. Elmira Bruce one
fourth to Alma Bruce one fourth to Mrs. Leila Blue and one fourth to the
children of J.I. Bruce then in life or the heirs of any who may die
share and share alike.
Item I
hereby appoint my son E.D. Bruce and G.W. Bruce Executors of this my
last will and testament without bond and it is expressly stipulated that
they shall not be required to make any return or be otherwise answerable
to any Court. In Testimony of all which I the said Lovina Bruce have
hereunto set my hand and seal this the 4th day of March 1908.

The above
and foregoing paper Consisting was this day singed in our presence by
Lovina Bruce who declared the same to be her last will and testament and
the same is signed by us as Witnesses at her request in her presence and
in the presence of each other This the 4th day of March 1908.

The
foregoing copy of the Will of Lovina Bruce was this day filed in my
office by E.D. Bruce and G.W. Bruce together with their petition to
probate the same as executors named therein December 6th
1915, April 3rd 1916.

Personally
appeared D.B. Nicholson C.J. Pope and R. T. Pope and in addition to
being duly sworn and testifying orally before the Court of Ordinary this
day do further swear on oath that the foregoing is a true copy of the
last will and testament of Lovina Bruce deceased the original will was
signed published and declared as her last will and testament by Lovina
Bruce in the presence of all of us and that at the special instance and
request of the said Lovina Bruce each of us in the presence of the
testatrix and of each other signed our names thereto as subscribing
Witnesses after testatrix had signed her name thereto that the said
Lovina Bruce in their presence freely and voluntarily signed and
published the same as her last will and testament and at the time
thereof was of sound and disposing mind and memory.
