Last Will
and Testament

In the name
of God Amen, I John E. Maguire of the County of Wilcox and State of
Georgia being of sound and disposing mind and memory but of feeble
bodily health, do declare make and publish this my last will and
testament.
Item
I give and
bequeath my body to the grave to be buried in a Christian like manner by
my executors hereinafter named and appointed and I direct that my said
Executors shall pay the expenses of my said burial out of the first
moneys belonging to my estate which shall come into their hands. My
spirit I meekly entrust to the merciful God who gave it relying upon his
infinite love for my eternal welfare.
Item
I direct
that my executors shall pay all my just debts and for the payment of the
same I hereby dedicate and set apart the proceeds of the sale of my
former home place in Dekalb County said State sold by me to Riley
Coggins and for which he now holds my bond for titles: also lot of land
number Seventeen in the twelfth (12th) district of Wilcox
County And my said executors are hereby fully empowered to make titles
to said Coggin for said lands upon payment by him of the purchase money
therefore and they are further empowered to sell said lot number
seventeen and make title to the same if necessary to pay my just debts,
and the charges and expenses of carrying out the several trusts herein
report in there. And in case the said Riley Coggins for any cause fails
to pay for the said lands in Dekalb County and my said executors shall
come into possession of them they, my said executors are hereby fully
empowered authorized and directed to sell said lands in such manner as
may by them be deemed most advantageous for the purpose of paying my
just debts and make title transfer to the purchase.
Item
I give
devise and bequeath to my beloved sons John Murphy Maguire and George
Thomas Maguire all my lands and all my interest in lands in the counties
of Wilcox, Clinch and Echols in said State of Georgia equally and Share
and share alike. I also give and bequeath all my personal property of
every kind and description also all evidence of debt and chosen in
action belonging to me to be theirs equally share and share alike.
Item
I hereby
appoint my sister S.E. Minor of Orange County, State of Florida Guardian
without bond for my said son George Thomas Maguire till he shall arrive
at lawful age of twenty one years with power and authority to spend for
him in his support and education such as she may deem prudent.
I tem
I herein
and hereby confer upon my executors hereinafter named and appointed full
power and authority to manage windup and dispose of all matters and
affairs connected with my estate in such way and manner as they may deem
wisest and most advantageous.
And
Specially to fulfill and carry out the contract made my me with C. J.
Haden of Fulton County, Georgia concerning the lands for which I hold
his bond for titles in the Counties of Wilcox, Clinch and Echols and the
said C. J. Haden is hereby directed to make title to said lands to my
said Executors according to the purpose and tenor of said contract which
said contract and bond for title bear the date the 11th day
of October 1897.
Item
I hereby
name and appoint D.B. Nicholson Esq. to be the legal adviser of my said
executors; he to have reasonable compensation for his services.

I hereby
name constitute and appoint my beloved sister S.E. Minor and my beloved
son John Murphy Maguire executors without bond of this my last will and
testament with full power and authority to carry out all the tenets
therein set forth.
In
testimony of all which I John E. Maguire have hereunto set my hand this
13th day of December 1898

The above
and foregoing last will and testament of John E. Maguire was made
executed and signed by him in our presence and signed by us at his
request in his presence and in the presence of each other as subscribing
witnesses: he stating to us and to each of that that the same was his
last will and testament this 13th day of December 1898.

personally appeared D. F. McCrimmon, W. D. Bullington and J.T. Lee named
as witnesses to the foregoing and within writing purporting to be the
last will of J.E. Maguire who being duly sworn deposes and says that
they did on the 13th day of December 1898 attest as witnesses
the foregoing and within writing in the presence of J.E. Maguire who in
their presence voluntarily signed and published the same as his last
will: and that the said J.E. Maguire was at the time of said attestation
and signing of sound and disposing mind and memory.
