In the name of God amen, I James Holt of the State and
County aforesaid being of advanced age and knowing that I must shortly depart
this life deem it right and proper both to myself and family that I should make
a disposition of the property with which a kind Providence has blessed me
therefore make this my last will and testament revoking and annulling all others
heretofore made by me.
Item First
I desire and direct that my body be buried in a decent and
christianlike manner natural to my circumstances and connection, my soul I
trust shall return to rest with God who gave it as I hope for eternal salvation
through blessed Savior Jesus Christ whose religion I have professed & as I
humbly trust enjoyed for many years.
Item Second
I desire and direct that all my just debts be paid without
delay by my executor hereinafter named as I am unwilling my creditors should be
delayed of their rights especially as there is no necessity for delay.
Item Third
I give & devise to my fours sons, James F. Holt, William L.
Holt, Burnett R. Holt & Elijah I.T. Holt one thousand dollars for the purpose of
educating them provided that I do not live to raise & educate them, having given
the rest of my children and English education.
Item Fourth
I give and devise to my beloved wife Mary and equal portion
of all my remaining property both real and personal with my children it being
choice of said property during her natural life & then to go to my children or
their children.
Item Fifth
I give and devise unto my daughter Nancy Emiline Tippet
wife of Hardy F. Tippet to her and her children an equal portion of my remaining
property both real & personal it being one share and to any other children by
her present or any future husband, and if the said Nancy Emiline should die
without having children or if she should die bearing children and they die with
children then the property to go to my children & their children and I hereby
appoint Hardy F. Tippet trustee for the property herein bequeathed to my
daughter Nancy Emiline Tippet & her children.
Item Sixth
I give & devise unto my daughter Sarah Caroline Gregory,
wife of Lewis Gregory and Tempty Caroline Faircloth wife of Bennett Faircloth to
them & their children, and any other children by their present, or any future
husbands, each one share of all my remaining property both real & personal and
should either of Said daughters die without children or die having children
their children die without leaving children, then said shares of property to be
divided among my children and children’s children and I hereby appoint Lovet L.
Harrell trustee of the property belonging to each of my daughters Sarah Caroline
Gregory and her children Tempty Caroline Faircloth and her children.
Item Seventh
I give and devise unto my single daughter Ann Elafayre
Holt, Elizabeth Elender Holt, Winney Ann Penninay Holt and their children one
share each of all my remaining property both real and personal and the said Ann
Elafaire Holt, Elizabeth Elender Holt, & Winney Ann Penninay if either of them
die without children or die having children & said children die without children
then their shares of said property to go to my children to them & their children
and I hereby appoint Lovet L. Harrell trustee for the property belonging to my
daughters Ann Elafayre Holt, Elizabeth Elender Holt and Winney Ann Penninay Holt
and their children.
Item the Eighth
I give and devise unto my grandson, James Thomas Warren, a
son of my deceased daughter Mary Jane Warren wife of John W. Warren deceased one
share of all my remaining property both real & personal to him and to his
children and if the said James Thomas Warren should die without children or die
leaving children and said children die without children then said property to go
to my children to them, and their children.
Item the Ninth
I give & devise unto my four sons James F. Holt, William L.
Holt, Bennett R. Holt and Elijah I.T. Holt each one of all my remaining property
to them and their children and if either of my sons herein named die without
children or die leaving children & said children die without leaving children,
then said shares of property to go to my children, to them & their children.
Item the tenth
That my executor, the understated, my will, I hereby state
that after bequeathing one thousand dollars to my four sons to educate them. My
will is, that the remainder of my property both real & personal be directed
equally between my wife Mary and my children and grandchildren as heretofore
named and be subject to such restrictions as heretofore stated in each item.
Item the eleventh
I constitute & appoint my friend Lovet L. Harrell executor
to this my last will & testament, this May the first, eighteen hundred & sixty
three.

last Will & Testament. In the presence of us the subscribers who subscribe our
names hereto in the presence of said testator and of each other this May the
first eighteen hundred & sixty three.

Personally appeared before me the undersigned Redmon G.
Fulghum one of the subscribed witnesses who appeared before me this the 4th
day of May 1877 at chamber for the purpose of proving the within last will &
testament of James Holt, Testator and an oath he saw James Holt sign and publish
the same as his last Will & Testament on the day and year herein stated &
executed by him that he witnessed the same with the other witnesses thereto, at
the request of said James Holt and in his presence and saw the other witnesses
sign the same in the presence of each other and the presence of the testator and
at his request and that the same was signed by James Holt voluntarily and while
he was of sound & disposing mind & memory.
