Last Will
and Testament

I, G.C.
Mixon, of Wilcox County, Georgia, being of sound and disposing mind and
memory do make this my last will and testament hereby revoking all
others that I have heretofore made.
Item 1: It
is my will and desire that my body be buried in a decent and Christian
like manner.
Item 2: It
is my will and desire that my just debts be paid as soon as practicable
after my death, if any.
Item 3: I
give, bequeath and devise to my wife Tobe Mixon $1000.00 in cash.
Item 4: If
I should die during the year 1926, then and in that event I give and
devise to my said wife any amount that I may have spent in improving her
property and any amounts that I have advanced to make the crops on her
farm during the year 1926, but the bequest in this item is to be void
unless I die during the year 1926.
Said
devises herein to my wife to be in lieu of dower and years support.
Item 4: I
give and devise to my children, J.C. Mixon of Irwin County, Georgia,
Mrs. J.S. Gibbs of Wilcox County, Georgia and G.C. Mixon, Jr. of Ben
Hill County Georgia all of the residue of my estate, both real and
personal of every sort soever not herein before specially devised in
equal shares, share and share alike and in the event of the death of my
son G.C. Mixon, Jr. Without child or children, prior to my death, then
and in that event his share herein is to go to my other two children
named share and share alike.
Item 5: I
hereby constitute and appoint my said sons J.C. Mixon and G.C. Mixon,
Jr. joint executors of this my last will and testament and I expressly
confer upon them as such to administer my estate, excusing them from
giving any bond or making any returns to the ordinary, and if it should
be necessary to sell any of my estate, either realty or personally I
hereby confer, upon them the authority so to do either at private or
public sale without any advertisement, and to make to such purchaser or
purchasers good and sufficient titles to the same.

sealed, declared and published by G.C. Mixon, as his last will and
testament, in the presence of us, the undersigned, who subscribe our
names hereto in the presence of said testator, after he had signed his
name thereto and at his special instance and request, and in the
presence of each other.

and nominated executors
The above
stated petition coming one to be heard and it appearing that all parties
at interest are residents of the State of Georgia and are said juris,
and that each person was served with notice of the petition for probate
ten days before this term of the court, and it appearing to the court by
the testimony of all the subscribing witnesses that the instrument
offered for probate is the last will and testament of G.C. Mixon, Sr.
deceased, as alleged, in the petition of J.C. Mixon and G.C. Mixon Jr.
and no sufficient reason appearing why said will should not be admitted
to record as prayed.
It is
ordered that said will be and the same is hereby established in solemn
form as the last will and testament of G.C. Mixon Sr. and that the same
be admitted to record.
It is
ordered further that letters testamentary do issue to J.C. Mixon and G.C.
Mixon, Jr. the executors named in said will, upon each taking the usual
oath of office.
