In the name of God amen, I Frederick Brown of
the said county & state aforesaid being of sound mind knowing the uncertainty of
life & deeming it right & proper to make a distribution of the property with
which a kind Providence has blessed make this my last Will & Testament hereby
revoking all other wills heretofore by me made.
Item 1st I desire that after my
death my body be buried in a decent & christianlike manner suitable to my
conditions & circumstances of life.
Item 2nd I will & desire that as
soon after my death as circumstances will admit that my just debts be paid by my
executor hereinafter named out of the effects of my property estate or out of my
money that I may have at the time of my death or that may come into the hands of
my said executor from any other place.
Item 3rd I will & bequeath to my
wife Lucinda Brown four hundred (400) dollars & one bedstead & furniture. The
money to be kept in the hands of my executor hereinafter named & to be
apportioned by him t0 & for her support, use & benefit and at her death the
amount that may be in the hands of my executors that has not been consumed by my
said wife to revert back & become a part of my estate & equally divided among
the parties hereinafter named.
Item 4th I give & bequeath to Mary
Hutto the one tenth part of my estate both real & personal always excepting the
legatees bequeathed in Item the third 3rd.
Item 5th I give & bequeath to my
adopted daughter Nancy Brown, now the wife of James M. Griffin the tenth part of
my estate both real & personal always excepting the legatees bequeathed in Item
the third 3rd.
Item 6th I give & bequeath to my
adopted daughter Elizabeth Jane Brown, now the wife of Eldred Swain the tenth
part of my estate both real & personal always excepting the legatees bequeathed
in Item the third 3rd.
Item 7th I give & bequeath to James
H. Hutto the tenth part of my estate both real & personal always excepting the
legatees bequeathed in Item the third 3rd.
Item 8th I give & bequeath to
Lucinda Hutto the tenth part of my estate both real & personal always excepting
the legatees bequeathed in Item the third 3rd.
Item 9th I give & bequeath to
Madison D. Hutto the tenth part of my estate both real & personal always
excepting the legatees bequeathed in Item the third 3rd.
Item 10th I give & bequeath to
George Hutto the tenth part of my estate both real & personal always excepting
the legatees bequeathed in Item the third 3rd.
Item117th I give & bequeath to
Phillip Hutto the tenth part of my estate both real & personal always excepting
the legatees bequeathed in Item the third 3rd.
Item 12th I give & bequeath to Mary
Margaret Hutto the tenth part of my estate both real & personal always excepting
the legatees bequeathed in Item the third 3rd.
Item 13th I will & desire that if
Mary Hutto mentioned in item the 4th should give birth to another
child in the present year (eighteen hundred & sixty seven) 1867, that it the
said child be entitled to & inherit the one tenth part of my estae, both real &
personal always excepting the legatees bequeathed in Item the third 3rd.
Item 14th I hereby constitute &
appoint James O. Farnell of the County & State aforesaid my executor with full
power to carry out & execute this my last Will & Testament.

who subscribed our names hereto & in the presence of said Testator and of each
other.

Before me James W. Mashburn, Ordinary of said
county came in person James O. Farnell late of said county & also H. H. F. Reid,
witness to said will who being duly sworn deposeth that they saw the said
Frederick Brown sign seal, publish & declare the said instrument as his last
Will & Testament voluntarily & freely without compulsion & that we signed said
Will in presence of each other and said Frederick Brown sworn to & subscribed
before me this Sept. 10th 1867
