Last Will and Testament of Daniel McDuffie

 

Georgia Wilcox County:

 

I Daniel McDuffie of said State and County being of sound and disposing mind and memory do make this my Last Will and testament hereby revoking and annulling all others by me heretofore made.

Art 1st I desire and direct that my body be buried in a decent and Christian like manner suitable to my Circumstances and Condition in life.

 

Art 2nd I desire and direct that all my just debts be paid without delay by my executors hereinafter named and Appointed.

 

Art 3rd I hereby constitute and appoint my son M.W. McDuffie and O.D. Chastain my son in law executors of this my last Will and testament and expressly confer them power as such to administer my estate excusing them from giving any bond but willing that they shall make the proper returns to the Ordinary and I expressly confer upon them full authority and power to sell any part of my estate not herein devised at public or private sale with or without notice as they may deem best, and without any order of court making good and sufficient Conveyance to the purchasers and holding the proceeds of the said sale to the same uses and trustees herein described in the Several items of this my Will.

 

Art 4th I give bequeath and devise to my son John D. McDuffie the lot of land No 208 in the 5th land distribution of this County same being my farm not far from Pope City, Ga.

 

Art 5th I give bequeath and devise to the Children of my beloved daughter Queen E. Hannah all the land which I own in the lots Nos. 149 and 150 in the 8th land district of this County. The total 300 acres and the Children of Queen E. Hannah to whom I devise this land are Six in number and their respectively are Frank Hannah, Newton Hannah, Jackson Hannah, Nancy Hannah, Murdock Hannah and Katie Hannah.

 

Art 6th I give bequeath and devise to my son M.W. McDuffie the North half of lot no. 52 in the 1st land district of this County.

 

Art 7th I give bequeath and devise to my son George B. McDuffie the South half of lot no 52 in the 1st land district of this county.

 

Art 8th I give bequeath and devise to my daughter Mary J. Chastain the East half of lot no. 51 in the 1st land district of this County. This is page one of the will of Daniel McDuffie Same being Comprised of two pages.

This is the second page of the Will of Daniel McDuffie same being comprised of two pages.

 

Art 9th I give bequeath and devise the balance of my property both real and personal to my children Mary J. Chastain, John McDuffie, M.W. McDuffie, George McDuffie and the children of Queen E. Hannah who are to take (illegible) in lieu of their deceased parent.

 

Art 10th I have made no provisions in this will for my beloved wife Elizabeth Whitfield McDuffie because I have previously provided for her and know that my children will care for her and will provide for her for the balance of her natural life.

 

This the 20th day of November 1916.                      Daniel McDuffie

 

Signed Sealed declared and published by Daniel McDuffie as his last will and testament in the presence of us the undersigned who subscribe our names hereto in the presence of said testator after he had signed his name thereto and at his special instance and request and in the presence of  each other this 20th day of November 1916.
