State of Georgia County of Wilcox

I Mrs. Carrie Rogers of said State and County being of sound and disposing mind and memory do make this my last will and testament hereby revoking all wills heretofore made by me.

Item 1

I Will and desire that my entire estate both real and personal be taken charge of and controlled and managed by my executrix in the manner and for the purpose hereinafter presented and until each of my four now unmarried children is either married or of the age of twenty one years.

Item 2

My executrix shall as soon as possible first pay all my funeral expenses.

Item 3.

I will and desire that my executrix shall use and employ my estate and the income derived therefrom for the purpose of educating my youngest children and supporting and maintaining my four unmarried children so long as they remain unmarried and until each of my four now unmarried children shall either become married or attain the age of twenty one years. My executrix shall not use said estate for the support or maintenance of any of said children after they are married but shall continue to support and maintain the unmarried child or children until they are married or a division of my said estate be made as hereinafter pointed out.

Item 4.

My executrix is hereby authorized and empowered for the purpose of educating and supporting and maintaining my said children as above set forth to sell at private sale and execute titles to any portion of my estate she may deem proper.

Item 5

I will and desire that when each of my said children is either married or of the age of twenty one years that all my estate remaining in the hands of my executrix be divided among my five children or their heirs as follows: my two youngest children to be paid the sum of one hundred dollars each and the remainder of my estate then be divided among said five children or their heirs share and share alike except that the fifty dollars and lot of land given by me in my lifetime to my daughter Mrs. Maude Collins shall be included as a portion of her share of my estate.

Item 6

I do hereby constitute my daughter Bessie as my executrix of this my last will and testament she not being required to give any bond whatever or to make any return of her actings and doings in the management and control of my estate.

In testimony whereof I have hereunto set my hand and affixed my seal this the first day of May Nineteen hundred and one.

Signed and published by Mrs. Carrie Rogers as her last will and testament in the presence of the undersigned who subscribed our names hereto as witnesses at the instance and request of the said testatrix and in her presence and in the presence of each other this the 1st day of May 1901.

I Martin Cannon do swear that I as well as Mary E. Bryan & Luvennia Cannon saw the within named Mrs. Carrie Rogers sign and publish the within attached paper as her last will and testament that I subscribed the same as Witness thereto at the special instance and request of the said Mrs. Carrie Rogers and in her presence as did also Mary E. Bryan & Luvennia Cannon in the presence of testatrix and of each other that the said Mrs. Carrie Rogers signed the same freely and voluntarily and was at the time of such signing of sound and disposing mind and memory.

To J.M. Warren Ordinary said County, The petition of Bessie Rogers shows that Mrs. Carrie Rogers late of said County departed this life on the 30th day of June 1902 after having made her last will and testament wherein your petitioner is nominated the executrix Your petitioner produces said will in Court and prays that he same may be admitted to record upon he proof thereof in Common form and that letters testamentary issue to her in terms of the law . And your petitioners will ever pray, etc.

The foregoing petition of Bessie Rogers nominated executrix of the last alledged will of Mrs. Carrie Rogers deceased having duly filed said alleged will and the same having been supported by proper proof Martin Cannon a subscribing witness to the said alleged will of Mrs. Carrie Rogers deceased as shown in affidavit of probate attached to said alledged will: It is ordered by the Court that said will with aforesaid affidavit be admitted to record as having been satisfactory proven in Common form Let letters testamentary issue to Bessie Rogers upon her taking the usual oath.
